Swanson: Force Majeure Examples Now Starting In Oil and Gas
/

Josh Swanson, Vogel Law Firm, talks about the recent examples of “force majeure” popping up in the oil and gas industry. From Oklahoma Governor Kevin Stitt’s letter to President Donald Trump to Continental Resources, force majeure is being seen more and more in industry.

Swanson discusses the potential issue of “state” and “federal” leases and oversight. Who is directing people to stay home, where the leases are held as well as other issues that stem from the force majeure clause.

The interview begins with NFL draft talk since Swanson moonlights as a NDSU Sports Podcaster. Players from NDSU and Wyoming are discussed as well as the Baltimore Ravens interesting offensive choices for next season.

Swanson gives an update on a few legal issues impacting energy, including the North Dakota Board of University and School Lands vs. Wilkinsons involving the mineral rights under Lake Sakakawea.

The interview circles back to force majeure talk in that, Swanson can not recall a time in history where this clause in a contract is implemented at a worldwide level.
