Two energy related bills have passed step one in Wyoming – HB0190 and SF0154.
HB0190 – Wyoming value added energy and industrial plan.
SF0154 – Energy authority project financing-refineries.
HB0190 is relating to the administration of government; creating the select committee on the Wyoming value added energy, economic development and industrial plan; specifying membership and duties of the select committee; authorizing the creation of task forces; specifying requirements and duties associated with created task forces; requiring reports and recommendations; providing appropriations; providing legislative findings; and providing for an effective date.
SF0154 is relating to the Wyoming energy authority; amending the purposes of the Wyoming energy authority to include the construction and expansion of oil and gas refineries in Wyoming; specifying that the energy authority may finance refinery projects in Wyoming as specified; and providing for an effective date.
There were several other bills introduced that did not make it to the next level quite yet.
HB0193, a “Carbon capture energy standards Bill”, Did not Consider for Introduction.
HB0106, an “Eminent domain-wind energy collector systems”, Introduced and Referred to S07 – Corporations.
HB0213, is an “Energy production inventory exemption”, Placed on General File
Other ESG Bills in Wyoming
The state of Wyoming has filed another ESG -related bill in the 2023 legislative session – SENATE JOINT RESOLUTION NO. – SJ 0159.
The bill states that “numerous essential American industries, including fossil fuel production, agriculture, timber production and firearms, are being targeted for boycotting, divesting and sanctioning by large corporations and public and private institutional investors”.
The bill continues (see below), to list ten (10) more items of discovery, fact and context.
Next the bill defines a number of terms, phrases and ideologies. For examples, “Economic boycott” means, without an ordinary business purpose, refusing to deal with, terminating business activities with or otherwise taking any commercial action that is intended to penalize, inflict economic harm on, limit commercial relations with or change or limit the activities of a company because the company, without violating state or federal law.
The bill also defines “contracts with governmental entities; requirements; exceptions” which still is confusing on one hand, yet clarifying on the other.
If someone is in “violation” of the ESG Boycott law, there are consequences. The attorney general or district attorney in the county where a violation of this act occurs may enforce this act and any contract subject to this act after opening an investigation into the matter.
This type of power over the people and control over a community can be used for productive, wasteful and vengeful means, therefore, it is important to spell out accountability sooner rather than later.
This latest ESG Boycott bill follows up SJ0004, which phases out EV sales by 2035 to “ensure the stability” of its oil and gas industry.
Senators Jim Anderson, Brian Boner, Ed Cooper, Dan Dockstader, Representatives Donald Burkhart, Jr, and Bill Henderson sponsored the bill SJ0004.
In the bill, it cites that oil and gas production has been one of the state’s “proud and valued industries”, creating “countless jobs” and contributing “revenues to the state of Wyoming throughout the state’s history.”
The bill also cited a lack of EV charging infrastructure which would “make the widespread use of electric vehicles impracticable for the state.”
The bill cites that gas-powered vehicles are a reason for allowing the state’s industries and businesses to flourish and criticize the use of batteries in electric vehicles due to the critical minerals contained in them.
Furthermore, the bill states that the minerals in the batteries are “not easily recyclable or disposable” and claimed that municipal landfills in the state would be required to develop safe and responsible disposal solutions for the minerals.
The bill also compares the oil and gas industry and the EV “The proliferation of electric vehicles at the expense of gas-powered vehicles will have deleterious impacts on Wyoming’s communities and will be detrimental to Wyoming’s economy and the ability for the country to efficiently engage in commerce.”
